1. About These Terms
These Terms and Conditions (“Terms”) govern the use of the Turtle English application (the “App”), an educational application provided by Temze Ltd (“we”, “us”, or “our”), and any other related agreement or legal relationship with us in a legally binding way.
Temze Ltd is a private limited company registered in England and Wales. For contact details, see the Contact Us section.
You must read this document carefully.
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not download or use the App.
Nothing in these Terms creates any relationship of employment, agency, or partnership between the involved parties. These Terms do not affect any statutory rights that you have as a consumer under applicable law.
2. About the App
The App provides educational content, learning materials, exercises, quizzes and related features intended to support learning and practice.
Some features may be available free of charge, while other features or content may require a paid subscription or a one-off purchase.
The App does not require users to create an account with Temze Ltd.
We may develop, update, modify or improve the App and its content from time to time.
3. Purposes of the App
The App is provided as an educational and learning aid.
Although we take reasonable care in preparing the content, the App is not intended to replace professional teaching, educational assessment or other professional advice.
Learning results may vary between users. We do not guarantee that use of the App will result in any particular educational outcome, examination result, qualification, language level or other achievement.
Where educational content is classified according to a particular level, such as a language proficiency level, school year, or educational framework, that classification is indicative only and does not constitute an official classification or assessment unless expressly stated otherwise.

4. Device Performance and Requirements
Because the App operates entirely locally on your device, its performance, loading speeds, and battery usage depend directly on your device's hardware, available storage space, and operating system version. You are solely responsible for ensuring your device meets the technical requirements necessary to run the App. Temze Ltd is not responsible for performance degradation, device overheating, or battery drainage caused by local hardware limitations.
5. Open-Source Software
The App may contain third-party open-source software components. Any such components are governed by their respective open-source licenses. To the extent required by those licenses, the terms of such open-source licenses will apply to those specific components in lieu of these Terms. A list of third-party attributions and licenses can be viewed in the App's settings menu or legal documentation.
6. Age Eligibility and General Audience
The App is intended for a general audience, and we do not impose a minimum age requirement to access its educational content. To ensure absolute privacy for all users, including children, this is a completely offline application. We do not collect, transmit, or store any personal data, behavioral tracking, or quiz results on external servers. All user progress and quiz data are saved strictly on your local device.
7. Purchases and Parental Responsibility
If you are under the legal age of majority in your jurisdiction, any purchase or subscription must be made or authorised by your parent, legal guardian, or an authorized adult.
Parents and guardians are responsible for supervising all purchases made by children using devices or app store accounts under their control.
While the App is a general-audience (non-age-restricted) application, we strongly recommend that younger users access it under parental or adult supervision.
8. Licence to Use the App
Subject to these Terms, Temze Ltd grants you a limited, personal, non-exclusive, non-transferable and revocable licence to download, install and use the App for your own personal, non-commercial use.
This licence does not transfer ownership of the App or any of its content to you.
Your use of the App may also be subject to the Terms and Conditions of the platform through which you downloaded it, including Google Play or the Apple App Store.
Although the entire contractual relationship relating to the App is entered into solely between the Temze Ltd and you, you acknowledge and agree that, where the App has been provided to you via the Apple App Store, Apple may enforce these Terms as a third-party beneficiary.
9. Intellectual Property Rights
The App and its contents are owned by or licensed to Temze Ltd and are protected by applicable intellectual property laws.
This includes, where applicable, software, source code, object code, databases, text, educational materials, questions, exercises, explanations, graphics, illustrations, icons, logos, designs, layouts, audio, visual material and other content contained within the App.
Except where permitted by law or expressly authorised by us in writing, you may not copy, reproduce, republish, distribute, sell, license, modify, translate, create derivative works from, commercially exploit or otherwise make available the App or any part of its content.
Nothing in these Terms transfers any intellectual property rights owned by Temze Ltd to you.
10. Free and Paid Features
The App contains both free and paid features. Some content is available for free, and full access to all learning materials and quizzes can be unlocked via an in-app purchase (a monthly or yearly subscription, or a one-time lifetime purchase).
A free trial period may also be available for new users upon first installing the App, during which you can access all content and quizzes for free. The paid features available to you will be described on the relevant purchase screen before you complete a purchase.
We may change which features are offered free of charge or as paid features for future users or future purchases. Any such change will be subject to applicable consumer law and will not remove paid access that you are already entitled to receive without a lawful basis.
11. Subscriptions and Lifetime Access
The App may offer monthly and annual subscriptions and a one-off Lifetime Access purchase. Prices and the features included with each purchase are displayed before the purchase.
This Application utilizes automatic renewal for subscriptions. All subscriptions, payments, automatic renewals, and cancellations are processed securely through and governed by the respective terms of the Apple App Store or Google Play Store. Specific details regarding the renewal period, termination procedures, and required notice periods are managed through your mobile device's store account settings. The app store through which you purchase your subscription may notify you of renewals, price changes, and other billing matters in accordance with its own terms and applicable law.
The App may also offer Lifetime Access as a one-off purchase, which means access to the applicable paid features of the App for as long as Temze Ltd continues to make the App and those features available. It does not mean the lifetime of the user and does not guarantee that the App will be maintained or available indefinitely. Lifetime Access is not a subscription, does not automatically renew, and does not necessarily include separate future products, applications, or services released by Temze Ltd unless we expressly state that they are included.
12. Cancelling a Subscription
You may cancel an auto-renewing subscription through the platform through which you purchased it.
- For subscriptions purchased through Google Play, you can manage or cancel the subscription through your Google Play subscription settings.
- For subscriptions purchased through the Apple App Store, you can manage or cancel the subscription through your Apple subscription settings.
Cancelling a subscription normally stops future renewals. Unless the applicable app-store rules or applicable law provide otherwise, you will continue to have access to the subscription features until the end of the billing period for which you have already paid.
Deleting or uninstalling the App does not cancel a subscription. The App will provide access to an appropriate method for managing or cancelling an active subscription where required by the applicable app-store rules.
13. Purchases Through App Stores
Purchases made through Google Play or the Apple App Store are processed by the applicable platform. The relevant app store is responsible for processing payments, issuing receipts, maintaining purchase records, and providing mechanisms for managing subscriptions and requesting refunds.
Your purchase is therefore subject to the applicable terms, billing rules, and policies of Google Play or the Apple App Store. Prices may vary by country or region and may include applicable taxes as determined by the relevant app store. Where there is a conflict between these Terms and mandatory consumer law, mandatory consumer law will apply.
14. Refunds, Cancellation Rights and Consumer Rights
Your rights concerning cancellation and refunds depend on applicable law, the type of purchase, and the app store through which the purchase was made. Nothing in these Terms excludes or restricts rights or remedies that cannot lawfully be excluded or restricted.
Where digital content is supplied immediately following a purchase, applicable law may affect your right to cancel after supply of that digital content has begun. Any consent or acknowledgement required by law in connection with immediate supply will be handled as part of the applicable purchase process. For purchases processed by Google Play or the Apple App Store, all refund requests must be submitted directly through the applicable platform in accordance with its procedures. Temze Ltd cannot directly issue refunds for purchases made through third-party app stores.
15. Restoring Purchases
Where supported by the applicable platform, previously purchased access may be restored using the purchasing account and the purchase-restoration mechanisms provided by Google Play or the Apple App Store.
Because the App does not require a Temze Ltd user account, entitlement to paid features depends entirely on the records and functionality provided by the relevant app store. Changing platforms, app-store accounts, or operating systems may affect your ability to restore a purchase. Unless expressly stated otherwise, a purchase made through one app store does not guarantee entitlement to an equivalent purchase through another app store.
16. Prohibited Uses
You must not use the App:
- For any unlawful or fraudulent purpose;
- In a way that infringes the intellectual property, privacy, or other legal rights of Temze Ltd or another person;
- To copy, reproduce, distribute, resell, or commercially exploit the App or its content except where expressly permitted by law;
- To introduce viruses, malicious code, Trojan horses, worms, or other technologically harmful material;
- To interfere with, damage, disrupt, or compromise the App, its software, security protocols, or underlying systems;
- To attempt to gain unauthorised access to the App, its restricted functionality, or any connected servers or databases;
- To bypass, disable, circumvent, or interfere with security, payment processing, licensing, or access-control mechanisms;
- To obtain paid content or premium functionality without making the required purchase through the applicable app store;
- To reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except to the extent that applicable law expressly permits such activity despite this restriction; or
- To use automated methods (including bots, scrapers, crawlers, or spiders) to systematically extract, harvest, or reproduce any content from the App.
17. User Content and Communications
The App does not provide functionality for users to publicly upload, post, or publish comments, images, videos, or other user-generated content. The App does not operate a public forum, social network, or user-to-user messaging service.
If you choose to contact Temze Ltd directly with questions, bug reports, ideas, or feedback regarding the App, you agree that we may use, implement, and share this information to improve our services without any obligation, compensation, or restriction to you.
18. Availability, Maintenance and Updates
We aim to keep the App available and functioning properly, but we do not guarantee uninterrupted, secure, or error-free availability. The App may occasionally be unavailable or fail to function properly due to scheduled maintenance, technical problems, platform updates, operating system changes, or circumstances outside our reasonable control.
We may release updates to fix bugs, improve security, maintain platform compatibility, modify or expand educational content (including correcting, revising, or removing questions and exercises), or alter the design and functionality of the App. You acknowledge that some updates may be mandatory for the App to continue functioning correctly on your device.
We reserve the right to eventually discontinue the App or phase out particular features. We will not use this provision to unfairly deprive you of material paid features that you have already purchased, or to circumvent obligations imposed on us by applicable consumer law and relevant app-store requirements.
19. Disclaimer and Statutory Rights
We take reasonable care in developing and maintaining the App and its educational content. However, the educational information provided within the App is for general informational purposes only; it may occasionally contain typographical errors, inaccuracies, or become outdated, and individual learning outcomes or exam results cannot be guaranteed.
Except as expressly stated in these Terms, and to the maximum extent permitted by applicable law, the App and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not guarantee that every feature will operate without interruption, that the App will be compatible with every mobile device or operating system version, or that it will meet your specific educational requirements.
Nothing in these Terms excludes or limits any warranty, condition, right, or remedy that cannot lawfully be excluded or limited under applicable law, including your statutory consumer rights relating to digital content.
20. Limitation of Liability
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. In particular, nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.
We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. We are not responsible for losses that were not foreseeable when you entered into the contract with us.
To the maximum extent permitted by applicable law, our total financial liability to you for any claims arising out of or relating to your use of the App shall be strictly limited to the total amount paid by you to us through the App (or the applicable app store) during the twelve (12) months preceding the claim.
The App is provided strictly for personal and non-commercial use. If you use the App for a commercial or business purpose, we are not responsible for any business losses, including but not limited to loss of profits, revenue, business opportunities, goodwill, or business interruption.
Nothing in this section affects your statutory consumer rights.
21. Responsibility for Misuse of the App
You are responsible for your own use of the App and for complying with these Terms. If your deliberate unlawful use of the App or deliberate infringement of another person's rights causes Temze Ltd to suffer a loss or become subject to a third-party claim, you may be responsible for the resulting losses to the extent permitted by applicable law.
This provision does not require you to compensate Temze Ltd for losses caused by our own negligence, breach of these Terms, or other wrongdoing, and it does not restrict any rights you have under consumer law.
22. Privacy and Data
The App does not require you to create a Temze Ltd account or provide an email address to use its features. Temze Ltd does not collect personal information through account registration, advertising, or marketing within the App.
However, the platform through which you download or purchase the App (such as Google Play or the Apple App Store) may process your information independently in accordance with its own privacy policy. Your device or operating system may also process technical information necessary to install, operate, update, or purchase content through the App. Please refer to our Privacy Policy for further information about how privacy and data are handled.
23. Advertising and Marketing
The App does not contain third-party advertising or commercial tracking. We do not use the App to send marketing newsletters, and the App does not require email registration with Temze Ltd.
24. Third-Party Platforms
The App is distributed through third-party platforms, including Google Play and the Apple App Store. These platforms are operated independently of Temze Ltd and have their own terms, privacy policies, and rules.
Temze Ltd is not responsible for the operation, uptime, or billing issues of Google Play, the Apple App Store, or other third-party services outside our control. Where platform-specific terms are required as a condition of distribution, those terms also apply to your use of the App.
25. Suspension and Termination
You may stop using the App at any time. We may restrict or terminate your access to the App where reasonably necessary because of serious or repeated misuse, unlawful activity, security concerns, or a material breach of these Terms. We will not use this right arbitrarily or in a way that unfairly deprives a consumer of paid access.
Termination of your right to use the App does not affect rights and obligations that arose before termination. As stated in Section 10 (Cancelling a Subscription), if you have an active subscription, uninstalling the App does not automatically cancel it; you must cancel the subscription directly through your app store settings.
26. Changes to These Terms
We may update these Terms from time to time to reflect changes to the App, our business, applicable law, or app-store requirements. The latest version of the Terms will be published on this page, and the Last updated date will be amended accordingly.
For minor changes that do not materially affect your rights or obligations, updating the Terms and the Last updated date will generally be sufficient. Where a change materially affects your rights or obligations, we will provide additional notice through the App where practicable or as required by law. Changes will not retrospectively remove statutory consumer rights that have already accrued. If the App is offline or does not have an Internet connection, notification of changes may be delayed until an Internet connection becomes available.
Where a change requires your agreement, we will request it through the App when the updated Terms can be presented to you. Until then, the previously applicable Terms will continue to apply, subject to applicable law. Where acceptance of updated Terms is required, access to the affected features may be restricted until you accept them.
27. Severability
If any provision of these Terms is found by a court or other competent authority to be unlawful, invalid, or unenforceable, that specific provision will be treated as removed or limited to the minimum extent necessary. The remaining provisions of these Terms will continue in full force and effect.
28. No Waiver
If we do not immediately enforce a provision of these Terms against a breach, this does not mean we have waived our right to enforce that provision, or any other provision, at a later date.
29. Governing Law and Jurisdiction
These Terms, and any dispute arising out of or in connection with them, are governed by the laws of England and Wales.
If you are a consumer resident in another country or another region of the United Kingdom, this choice of law is subject to any mandatory consumer protections that apply in your place of residence. You retain the right to bring legal proceedings against us in your local courts where you are entitled to do so under applicable consumer law.
Nothing in these Terms is intended to limit or restrict your statutory rights as a consumer in your home jurisdiction.
